Construction Site Storm Water Permitting Notice

All developers, contractors and homeowners who are engaged in construction activities that will disturb 1 acre or more MUST comply with National Pollutant Discharge Elimination System (NPDES) and Texas Pollutant Discharge Elimination System (TPDES) rules. The following information will help you meet these requirements.

All developers, contractors and homeowners who are engaged in construction activities that will disturb 1 acre or more MUST comply with National Pollutant Discharge Elimination System (NPDES) and Texas Pollutant Discharge Elimination System (TPDES) rules.  The following information will help you meet these requirements. 

        I.      Texas Commission On Environmental Quality Requirements are as follows:

Large Construction Activity (5 or more acres)

The following steps must be completed to obtain authorization to discharge under the TPDES Construction General Permit:

1.       Obtain a copy of the TPDES Construction General Permit No. TXR150000 online by visiting: www.tnrcc.state.tx.us/permitting/waterperm/wwperm/txr150000.pdf.

2.       Develop and implement a Storm Water Pollution Prevention Plan (SWP3).  Examples and additional guidance can be found online at:  www.baytown.org/public/stormwater/stormwater-permitting-notice.htm

3.       Complete and submit an Notice of Intent (NOI) to TCEQ - the online form is available at:  www.tnrcc.state.tx.us/permitting/forms/20022.pdf.   

4.       Post a copy of the NOI and a copy of the construction site notice at the construction site.  Available online at: www.tnrcc.state.tx.us/permitting/waterperm/wwperm/txr152d2.pdf.

5.       Following completion of the submit a Notice of Termination (NOT) www.tnrcc.state.tx.us/permitting/forms/20023.pdf to TCEQ and the local MS4 operator.

Small Construction Activity (1 to less than 5 acres)

1.             Obtain a copy of the TPDES Construction General Permit No. TXR150000 online by visiting: www.tnrcc.state.tx.us/permitting/waterperm/wwperm/txr150000.pdf.

2.             Develop and implement a Storm Water Pollution Prevention Plan (SWP3).  Examples and additional guidance can be found online at: www.baytown.org/public/stormwater/stormwater-permitting-notice.htm

3.             Post a copy of the Construction Site Notice at the construction site.  Available online at: www.tnrcc.state.tx.us/permitting/waterperm/wwperm/txr152d2.pdf.

      II.      City of Baytown requirements are as follows:

For large construction sites – submit a copy of the NOI and fee check submitted to TCEQ, along with the written SWP3 and the SWP3 drawings. The SWP3 must be submitted as part of the civil review for the City of Baytown. 

For small construction sites – submit a copy of the Construction Site Notice and the written SWP3 and SWP3 drawings.  The SWP3 must be submitted as part of the civil review for the City of Baytown. 

Submissions to the City of Baytown should be made to:  Storm Water Division, 220 West Defee, Baytown, TX 77522 or may be submitted with the Civil Plans submitted to the City for plan review.
